This policy applies to purchases of access to the online course The Great Conversation (the “Course”) from Christian McTighe, trading as CWM Digital Technologies, Christel-Küpper-Platz 17, 81379 München, Germany (“we,” “us,” or “our”). It forms part of our Terms and Conditions.
1. At a glance
- The Course is a one-time purchase. There is no subscription, so there is nothing to cancel.
- If you are a consumer, you have a statutory 14-day right of withdrawal (Section 3).
- At checkout, you choose to start the Course immediately. Your right of withdrawal then ends as soon as your access is activated (Section 4).
- Beyond your statutory rights, there is no entitlement to a refund (Section 5).
- Your statutory rights if the Course is defective or not provided are not affected (Section 6).
2. Consumers and business customers
A consumer is a natural person who makes the purchase for purposes that are predominantly outside their trade, business, or profession.
The statutory right of withdrawal in Sections 3 and 4 applies only to consumers. If you buy the Course for your business or profession, you have no right of withdrawal. Sections 5 to 13 apply to all customers.
3. Right of withdrawal (consumers)
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day of the conclusion of the contract.
To exercise the right of withdrawal, you must inform us (Christian McTighe, Christel-Küpper-Platz 17, 81379 München, Germany, +49 89 21295839, info@cwm-digitaltech.com) of your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory. You can also exercise your right of withdrawal online at https://greatconversationcourse.com/withdraw. If you use this online function, we will send you, without undue delay, an acknowledgement of receipt on a durable medium (for example, by email) containing the content of your withdrawal statement and the date and time of its receipt.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
4. Early expiry of the right of withdrawal (immediate access)
Because the Course is digital content that is not supplied on a physical medium, your right of withdrawal expires early once we have begun providing the Course (that is, once your access is activated), provided that:
- you have expressly agreed that we begin providing the Course before the end of the withdrawal period;
- you have confirmed that you are aware that you lose your right of withdrawal once we begin; and
- we have sent you a confirmation of the contract that includes this consent and acknowledgement.
You give this consent and acknowledgement at checkout by checking the box:
Start learning right away
I want immediate access to the course. I expressly agree that you begin providing the course content before the 14-day withdrawal period ends, and I understand that I lose my right of withdrawal once access begins.
We confirm your consent in your order confirmation email. Access is activated immediately after your payment is completed, so your right of withdrawal ends at that point.
5. No refunds beyond your statutory rights
Apart from the rights described in Sections 3, 4, and 6, and any refund on discontinuation under Section 8 (Discontinuation of the Course) of our Terms and Conditions, purchases are final and there is no entitlement to a refund. This applies in particular if you change your mind, no longer need the Course, or have not used it.
In individual cases, we may grant a refund as a goodwill gesture at our sole discretion. A goodwill refund is voluntary; granting one in one case does not create an entitlement in any other case.
We will not grant a goodwill refund where we reasonably believe the request is fraudulent or abusive, for example repeated purchase-and-refund cycles, shared account access, or copying or downloading Course content to keep it.
Duplicate purchases: if you accidentally purchased the Course more than once, we will refund the duplicate purchase.
6. Defective or unavailable content
If the Course is not provided or does not conform to the contract (for example, if content cannot be accessed because of a technical fault on our side), you have the rights provided by law. For consumers, these are the statutory rights for digital products (Sections 327 et seq. of the German Civil Code, BGB). Depending on the circumstances, they may include having the problem fixed, a price reduction, or terminating the contract with a full or partial refund.
This policy does not limit these rights. Please let us know about technical problems as soon as possible so we can fix them quickly.
7. How to withdraw or request a refund
- To withdraw (consumers, Section 3): use the online withdrawal function at https://greatconversationcourse.com/withdraw, or send us a clear statement by email or letter. You may use the model withdrawal form below. No reason is required.
- For all other requests (Sections 5 and 6): email us at info@cwm-digitaltech.com with your name, the email address used for the purchase, your order or receipt number (if available), and a brief description of your request.
Writing from the email address associated with your account helps us find your purchase quickly.
8. How refunds are paid
- Refunds are paid to your original payment method via Stripe, our payment processor and merchant of record, and in the currency of your original purchase. A refund includes the tax you paid on the refunded amount. If you paid in your local currency, the refund uses the same exchange rate as your payment, so a full refund returns exactly the amount you paid, including any currency-conversion fee (see Section 5 of our Terms and Conditions).
- In some cases, Stripe may also issue a refund itself, for example after a request to Link support. Such a refund is treated like any other refund under this Section, and it does not give you an entitlement to a refund from us.
- Refunds after a statutory withdrawal are paid within the period stated in Section 3, without any fees.
- When your bank or card issuer credits the refund depends on them. Any exchange-rate differences or charges applied by your own bank or card issuer are outside our control.
- When a full refund is issued, your access to the Course ends and your license to use the Course content ends. A partial refund (for example, a price reduction) does not end your access.
9. Chargebacks and payment disputes
If you believe you are entitled to a refund, please contact us first. This is usually the quickest way to resolve the matter.
If a chargeback or payment dispute is opened for your purchase, Stripe handles the dispute process, and we may suspend your access to the Course until the dispute is resolved. If the dispute is resolved in your favor, your access ends. If it is resolved in our favor, your access is restored.
10. Leaving checkout before paying
If you leave the payment page before completing payment, no contract is concluded and you are not charged.
11. Mandatory consumer law
Nothing in this policy limits rights you have under mandatory consumer-protection law, including mandatory provisions of the law of the country where you live, where these apply.
12. Changes to this policy
We may update this policy from time to time. The version in effect at the time of your purchase applies to that purchase. The “Last updated” date above shows when this policy was last changed.
